The meeting convened at 6:00 p.m.
6:04 pm Public Hearing, Alpert, SMA NOI, request for amendment to existing OOC. Mt Hunger Rd
Applicant requested continuation of the hearing until the 11 September 2006 meeting. We continued the Hearing. Closed at 6:05pm
6:10 pm – 6:30pm Public Meeting, Halbreich, WPA RDA – 50 Laurel Banks, for repair of existing storage shed at the shore of L Buel, project of C Blair
Presenting were owner Halbreich and contractor John Andrus. The request was to repair an existing foundation damaged by winter ice. The bank side foundation was intact and the lake side foundation had fallen down. They proposed pouring a solid foundation beginning at the existing bank side out 6 feet for the full depth of the shed. They proposed braced plywood forms and use of a concrete pump truck to place the concrete. They proposed removal of the forms at the completion of the project. Work to be done in Sept and October before winter weather. A motion was made and approved to issue the Determination of Applicability as an N-2. The contractor was asked to call C Blair 48 hours before the intended concrete pour.
6:30pm – 7:30 pm Public Meeting, Kelly/Nadler WPA Enforcement action with letter 535 Main Rd
Mike Parson, Kelly, Granger, Parsons + Associates, and Stefan Grotz, Esq represented Bruce Kelly, also present.
This meeting was scheduled to allow Kelly to perform as directed in the 24 July 2006 Enforcement letter.
The applicant described the July 1997 tornado damage done to the property 1 day after purchasing the property. No work was conducted as in the Enforcement letter. Tree removal was conducted after the tornado; at the time the contractor L Tryon suggested a pond, which was constructed. The area was cut and stumped, including area on property of adjacent owner M Oislander. B Kelly said he contracts to have the field brush hogged x1 or x2 a year.
The commission made a difference between the tornado damage and the continued mowing. The commission felt the tornado activities were in the past. The commission directed Kelly and his representatives to delineate and map the current wetlands and buffer zone and to present a drawing showing such information. At that time we will request some form of marking on wetland boundaries. M Parson believed mowing in the Buffer Zone was allowed under WPA.
7:30 – 8:00pm Gould Farm, Diane’s Trail preliminary discussion
B Rausch and Jon Green asked some questions about design for repairs to existing foot bridges on the trail. Green displayed some design sketches. The ConCom asked if they could move the bridge surface above the flood plain. An engineer present suggested helical screw piers for anchoring the bridges. B Rausch wanted to know how to calculate the fee for the ANOI suggested as the proper form for application. Back to the drawing board.
8:00pm – 8:30pm informal discussion, Brenner, SMA NOI and WPA NOI–Elephant Rock Rd - for house expansion
R Hoogs of Foresight wanted to know if they could apply for an Amended OOC for their project. The ZBA hearing process resulted in some changes to the project: a) a rotation of a few degrees of the footprint to move the house from the setbacks, b) a reduction in total house height, and c) a removal of large stone terrace and eastern side stone walkway from the project. The ConCom thought it fine to file a request to amend the OOC.
8:30pm – 8:50pm Public Meeting, Sweeny, WPA RDA – 6 Bidwell Rd
Scott Jensen contractor presented for the Owner. The work is to remove the existing dock and 3” diameter pipe pier supports, damaged by the winter ice and replace it in place and in same materials. Some replacement of deck boards is required. He will require a generator to power a saw. A motion was made and accepted to approve the project as submitted.
8:50pm – 8:55pm - Public Meeting, New England Keswick, WPA RDA, Chestnut Hill Rd

8:55pm – 9:00pm Public Hearing, Roche, WPA NOI, proposal to remove silt from concrete pool system in river, Beartown Mountain Rd
No show; continuation of the hearing until the 11 September 2006 meeting. Waiting on animal habitat study from White Engineering. Closed at 9:00pm
General discussion:
1. Rothschild, ZBA request for ConCom opinion Reviewed plans and drafted letter.
2. Reviewed mail.
3. Talked about changing meeting time for ConCom.
4. Talked about holding site visit for Dolber to review possible violations of Enforcement Order and for site visit for Smith to review possible violations of Enforcement Order.
5. We voted to send dues to MACC for another year.
6. David related conversations with various citizens for regular ConCom business.
7. We approved minutes of the last three meetings.
